Scope of Application

These General Terms and Conditions (hereinafter referred to as “GTC”) apply to the provision, for consideration, of furnished apartments as well as to all additional services and deliveries pro-vided by b20 – serviced apartments bern ag (hereinafter referred to as “b20”) to guests. The GTC form an integral part of every contract. Should these GTC conflict with any contractual terms of guests or corporate partners, these GTC shall prevail. In all other respects, the relevant provisions of the Swiss Code of Obligations shall apply, excluding the provisions governing lease agree-ments.

Conclusion of Contract

Following the booking of an apartment-whether via a booking platform, directly via the b20 web-site (.www.b20 .eh), or by telephone or e-mail-guests will receive a booking confirmation by e-mail from b20. However, the booking becomes definitive only upon successful completion of the iden-tity verification procedure (ID check) and the provision of valid credit card details. If such infor-mation is incorrect or invalid, the reservation will be cancelled and deemed null and void. The transmission of credit card information is encrypted and fully PCI-compliant. At no time does b20 serviced apartments bern ag have access to the guests' credit card details.

Services, Payments and Prices

The price includes the provision of the furnished apartment for the agreed period as well as cleaning every 14 days (including the change of towels and bed linen). Additional services provided by b20 are charged separately. The units are designed for 1-2 people and are per-sonalized (no transfer to third parties).

All prices are stated in Swiss francs (CHF} and include the statutory value-added tax (VAT}. Unless otherwise agreed, overnight and accommodation taxes are not included in the price.

Exempt from overnight and accommodation taxes are people domiciled in the City of Bern, children and adolescents under the age of 16, members of the military and civil defense while on duty, weekly and short-term residents (who must be registered with the residents' registration office), and students.

b20 is entitled to request payment of the price for the provision of the furnished apartment, in whole or in part, at any time in advance. The amount of any advance payment and the payment dates are determined by the booking channel and the selected rate. If guests fail to meet their payment obligations within the specified period, b20 is entitled, after grant-ing a reasonable grace period, to withdraw from the contract. Guests shall be liable for any resulting damage incurred by b20.

If, after the end of the guests' stay, there remains an outstanding balance, the entire amount must be paid by the time of departure by credit card or debit card (EC/Maestro). If payment by invoice has been agreed, the total invoice amount is due within 10 days of the invoice date. In the event of late payment, b20 is entitled to charge default interest at a rateofS°/21.

Intheeventofanylatepayment byguests, theyauthorizeb20 tochargetheoutstanding amounts to the credit card provided.

Price changes by b20 are expressly reserved.

Accommodation Period

The units, which are designed as temporary housing solutions, can be hooked for a minimum of 5 days and a maximum of one year. Extensions beyond a total period of one year are granted only in exceptional cases.

Obligations of the Guests

When making a reservation, guests must state and provide proof of their residence status (Swiss citizenship, short-term resident, weekly resident). Guests acknowledge that their residence status aff ects the price (inter alia due to the payment of tourism promotion or accommodation taxes). If the information provided is incorrect, guests shall be liable to third parties (in particular to the tax authorities of the City and Canton of Bern) and shall fully indemnify b20.

Guests undertake to inspect the inventory within the first 4 days after moving into the apartment. If no damage to the room or missing or defective furnishings are reported, guests assume financial responsibility for any damage or defects.

At the time of booking, guests are required to provide a valid credit card with expiration date and CVV as a guarantee. The transmission of credit card information is encrypted and fully PCI-compliant. At no time does b20 serviced apartments bern ag have access to the credit card details. If any services are not paid within the specified period, guests au-thorize b20 to charge the outstanding amounts to the credit card.

Guests undertake to treat the furnishings with care and tobe considerate of other tenants (see hause rules).

Smoking is prohibited throughout the entire building. Any violation will be penalized with a fee of CHF300.00.

Arrival and Departure Times

The furnished apartments are available from 3:00 p.m. on the day of arrival and must be vacated by 12:00 noon on the day of departure.

Structural Alterations

Guests are not permitted to make any structural alterations to the furnished apartment.

Pets

Pets are not permitted in the furnished apartments of b20. Exceptions may be granted in special cases upon prior consultation with the parties responsible.

Liability

Guests are liable to b20 for all damage, loss, or other harm to the furnished apartment caused by themselves or third parties.

b20 assumes no liability for theft of or damage to items brought in by guests or third par-ties. Insurance coverage for such items is the responsibilityofthe guest.

b20 is liable only in cases of intent or gross negligence, whether contractual or non-con-tractual, and only for direct damage. Any further liability, in particular for slight or me-dium negligence or for indirect damage, is excluded.

 Right of Withdrawal of b20

If the services tobe provided by b20 are significantly impeded or rendered impossible in whole or in part due to force majeure or other circumstances beyond the control of b20, b20 may withdraw from the contract, in whole or in part, without compensation, with respect to the unfulfilled portion of the contract.

b20 is also entitled to withdraw from the contract without compensation if there is justi-fied reason to assume that the guests' stay at b20 may endanger safety. Any claims for damages by b20 against the guests remain expressly reserved.

Commercial use of the apartment by guests is not permitted.

Cancellation Policy

The conditions for cancellations or early departure are displayed at the time of booking the selected rate and are binding.

In the event of cancellation or early departure, the following cancellation deadlines apply to the respective rates:

• Long Stay Rate: Free cancellation up to 20 days before arrival or early departure
• Standard Rate: Free cancellation up to 14 days before arrival or early departure
• Short Stay Rate: Free cancellation up to 5 days before arrival or early departure

When booking the non-refundable rate, the entire stay is due at the time of booking. In the event of early departure or cancellation prior to arrival, no refund will be granted.

For all cancellations, any services already provided in advance by b20 and its partners must in any case be paid in full.

b20 reserves the right to contractually define individual cancellation conditions.

Severability Clause

Should individual provisions of these GTC be invalid, this shall not affect the validity of the re-maining provisions. In such a case, the invalid provision shall be replaced by a provision that is legally valid and most closely reflects the intended purpose.

Applicable Law / Place of Jurisdiction

Swiss law shall apply exclusively.

The courts at the registered office of b20 shall have exclusive jurisdiction over any dis-putes arising from this contract.
